These Terms of Use ("Terms") govern your access to and use of Third Eye’s websites and services, including thirdeyenow.com, our Orientation and Stages 1–7 training, mentorship/chat, timers, forms, and any other features we provide (collectively, the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

 

We are based in the United Kingdom and operate in accordance with UK law. Please also read our Privacy Policy, which explains how we handle personal information and forms part of these Terms by reference.

Our Services are intended for individuals aged 16 or over.

What we offer

 

Third Eye provides educational and training content focused on the human visual system. The Services include:

 

  • Public pages (e.g., Method, Science, Journey, Experiences, Training, About, Courses) and member‑only areas (Orientation and Stages 1–7).

  • Automated stage unlocks tied to elapsed time and your progress settings.

  • Mentorship/chat and check‑in forms for guided programmes.

  • In‑browser tools such as timers and other interactive experiences.

All courses are free.

 

Not medical advice.

 

The Services are educational and experiential. They are not medical, psychological, or therapeutic advice and are not a substitute for professional care. Do not disregard professional advice or delay seeking it because of content on the Services. Do not use the Services while driving or performing tasks that require full attention. Stop if you experience discomfort and seek appropriate guidance.

 

2A) Experiences & outcomes (disclaimer)

  • Subjective effects. Individual experiences vary. You may or may not perceive colours, lights, shapes, patterns or brightness changes, and any such perceptions are subjective to you.

  • No guarantees. We do not guarantee particular outcomes, effects or timelines. Progress timings are approximate and for guidance only.

  • Self‑responsibility. You are responsible for your environment, device settings (e.g., screen brightness) and whether to continue, modify or stop any activity. If you feel unwell or unsafe, pause or stop and, if needed, seek professional advice.

  • No professional relationship. Using the Services does not create a doctor–patient, therapist–client or other professional relationship.

2B) Visual‑sensitivity caution (photosensitivity/migraine)

 

Some content may include contrast or brightness changes, flicker‑like patterns, or high‑contrast imagery. If you have a history of photosensitive epilepsy, migraines, or visual sensitivity, consult an appropriate professional before using the Services. Stop immediately if you feel unwell (e.g., headache, nausea, visual disturbance, dizziness) and seek appropriate guidance.

 

Accounts and access

 

  • You may need an account to access member‑only areas. Keep your credentials secure; you are responsible for activity under your account.

  • We may change, suspend or terminate accounts or features to maintain the security, integrity, or performance of the Services, or if you breach these Terms.

  • We may introduce, modify or remove features from time to time.

 

Research and collaboration

We aim to advance understanding of the human visual system and may collaborate with scientists, research institutions and relevant bodies. See the Privacy Policy for details about data processing and your rights.

Your content

Some parts of the Services allow you to submit content (e.g., check‑ins, notes, messages, feedback). You retain ownership of your content. You grant Third Eye a non‑exclusive, worldwide, royalty‑free licence to host, store, reproduce and display your content only as needed to operate, maintain and improve the Services.

 

Community & moderation (no duty to monitor)

We do not undertake to proactively monitor user content. We may remove or restrict any content or account at our reasonable discretion where we believe these Terms are breached or where necessary to protect users, security or the integrity of the Services.

 

Acceptable use

 

You agree not to:

 

  1. Circumvent or attempt to circumvent stage‑gating or any technical restrictions (e.g., accessing locked stages early, scraping member content, manipulating timers).

  1. Copy, record, reproduce, distribute or publicly display any part of the Services except as permitted by these Terms or applicable law.

  1. Reverse engineer or otherwise attempt to derive source code from any part of the Services except to the extent such activity is expressly permitted by law.

  1. Upload or transmit content that is unlawful, infringing, defamatory, deceptive, harassing, harmful, or invasive of privacy, or that promotes violence or discrimination.

  1. Introduce malware, interfere with system integrity or security, or attempt to probe, scan or test the vulnerability of any system or network.

  1. Impersonate any person or entity, or misrepresent your affiliation with a person or entity.

  1. Use the Services to develop competing products or datasets through systematic scraping or bulk export.

 

We may suspend or terminate access where we reasonably believe these rules are breached.

Intellectual property

The Services (including training scripts, visual designs, UI components, videos, images, audio, text, logos and trademarks) are protected by intellectual property laws and are owned by or licensed to Third Eye.

 

We grant you a personal, limited, revocable, non‑transferable, non‑sublicensable licence to access and use the Services for your own non‑commercial purposes in accordance with these Terms. Except for this licence, no rights are granted.

 

If you choose to provide feedback or suggestions, you grant us a perpetual, irrevocable licence to use them without obligation to you.

 

Third‑party services and links

The Services may include links to third‑party websites or services. Those sites are not under our control and have their own terms and privacy notices. We are not responsible for their content or practices.

Service availability and changes

We aim to keep the Services available and improving. However, the Services may be interrupted, delayed or limited for maintenance, upgrades, or events beyond our control. Features may change over time. We will endeavour to provide reasonable notice of material changes where practicable.

 

Disclaimers

Except as required by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied (including implied warranties of satisfactory quality, fitness for a particular purpose, and non‑infringement).

 

Without limiting the foregoing, we are not responsible for subjective visual or sensory experiences you may perceive (for example colours, lights, patterns or brightness changes) or for decisions you take in reliance on such experiences.

 

Nothing in these Terms excludes or limits any warranty or liability that cannot be excluded or limited by law.

 

Limitation of liability

To the fullest extent permitted by law, Third Eye and its officers, employees and agents will not be liable for (a) any indirect, consequential, special or incidental damages, or (b) any loss of data, opportunities, goodwill or reputation, arising out of or related to your use of the Services.

 

For the avoidance of doubt, we will not be liable for any indirect or consequential loss arising from temporary visual phenomena or other subjective experiences reported during or after use of the Services, to the fullest extent permitted by law.

 

Except for Non‑Excludable Liabilities (including death or personal injury caused by negligence, fraud, and any liability that cannot be limited under the Consumer Rights Act 2015), we are responsible only for loss or damage that is a foreseeable result of our failing to use reasonable care and skill or our breach of contract. We are not responsible for loss not caused by our breach, for any indirect, incidental, special or consequential loss, or for business losses (including loss of profit, revenue, contracts, goodwill or data). The Services are provided without charge; the exclusions and limitations in this section reflect that and apply to the maximum extent permitted by law.

 

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under law.

 

Your responsibility & indemnity (narrow)

To the extent permitted by law, you agree to indemnify and hold harmless Third Eye against reasonable claims, costs and liabilities arising from: (a) your unlawful content or infringement of third‑party rights; or (b) your intentional misuse of the Services (for example bypassing stage‑gating or scraping). This does not apply to normal consumer use of the Services and does not limit your statutory rights.

 

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you materially or repeatedly breach these Terms, or where necessary to protect users, security, or the integrity of the Services. Upon termination, the licences granted to you under these Terms end. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, governing law) will survive termination.

Changes to these Terms

We may update these Terms from time to time (for example, to reflect new features or legal requirements). We will post changes here with a new "Last updated" date and, where appropriate, provide additional notice (e.g., via the site or email). If you continue to use the Services after the changes take effect, you agree to the updated Terms.

Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. You and we submit to the exclusive jurisdiction of the courts of England and Wales, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or confidential information.

 

International consumers — mandatory protections

 

If you are a consumer resident outside the UK, these Terms apply under English law without affecting any mandatory consumer protections in your country of residence that cannot be varied by contract.

 

General

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remainder will continue in full force and effect.

 

No waiver. Failure or delay by us to enforce a provision is not a waiver of that provision or any other provision.

 

Assignment. You may not assign or transfer these Terms (or your rights and obligations) without our prior written consent. We may assign or transfer these Terms in connection with a reorganisation, merger, acquisition or sale of assets.

 

Force majeure. We are not responsible for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, fire, flood, explosion, war, terrorism, civil disorder, industrial disputes, internet or telecommunication failures, platform outages, denial‑of‑service attacks, or acts of government.

 

Entire agreement. These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior understandings relating to the Services.
